Terms of Use
These terms apply to the Darc app and its Safari extension for iPhone, iPad and Mac ("Darc", "the app"), developed by Darius Cirjan ("we", "us"). By downloading or using Darc you agree to them. If you do not agree, do not use the app.
1. Apple's Standard EULA
Darc is licensed to you through the App Store under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA. If the two conflict, the Standard EULA applies, except where these terms give you more rights. Apple is not responsible for Darc or its support; we are.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to use Darc on Apple devices that you own or control, as allowed by the App Store usage rules. You may not copy, resell, rent, modify, reverse engineer or redistribute the app, except where the law allows it or an open source licence for a component permits it. Darc includes Dark Reader, which is licensed under the MIT License; see the acknowledgements.
3. Free features and Darc Forever
Darc is free to download and use. The free version includes the System, Dark and Off modes, automatic detection, photo and video protection, recovery, iCloud sync and up to 3 site rules.
Darc Forever is an optional one-time in-app purchase. It unlocks the light theme for dark sites, unlimited site rules, fine-tuning for all sites and per site, true black for OLED screens and dark hours. It is not a subscription and does not renew. The price is shown in the App Store before you buy, in your local currency.
- Payment is charged to your Apple Account by Apple when you confirm the purchase.
- Darc Forever is tied to your Apple Account and is available on your iPhone, iPad and Mac signed in with that account. Use Restore Purchases in the app to unlock it on another device.
- "Forever" means for as long as Darc is offered and works on your device and Apple's platforms. If Darc Forever is no longer active on your account, for example after a refund, your site rules are kept: rules beyond the free limit stay saved but inactive.
4. Refunds
All purchases are processed by Apple, and we cannot issue refunds ourselves. You can request a refund from Apple at reportaproblem.apple.com. Apple decides refund requests under its own policies. This does not affect any rights you have under consumer protection law.
5. Acceptable use
Use Darc only for lawful purposes and only to change how web content appears to you on your own devices. Do not use Darc to break the law, to interfere with a website's security, or to circumvent measures that protect a website or its users.
6. How websites look
Darc changes how websites look by restyling them on your device. Websites are built in many different ways and change often, so we cannot promise that every website will look perfect with every setting. Some elements may look different from the original, and some sites may need a site rule, a reset or to be turned off for that site. Darc deliberately leaves sensitive parts of pages, such as payment fields and CAPTCHA checks, as the site made them. You can always turn Darc off for a site or for all sites.
Websites belong to their owners. Darc does not change a website itself, only how it is displayed in your browser.
7. No warranty
To the extent permitted by law, Darc is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error free, or that it will work with every website, device or version of Safari.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or business, arising from your use of or inability to use Darc. Our total liability for any claim is limited to the amount you paid for Darc Forever. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence, or your statutory rights as a consumer.
9. Privacy
Our Privacy Policy explains how Darc handles information. In short, we collect none.
10. Changes and termination
We may update Darc and these terms. If we change the terms, we will post the new version on this page with a new effective date. Continuing to use Darc after a change means you accept the updated terms. Your licence ends if you break these terms; you can stop using Darc at any time by deleting it.
11. Governing law
These terms are governed by the laws of Romania. Disputes will be heard by the competent courts of Romania, unless the consumer protection law of the country where you live gives you the right to bring a claim there or to rely on its mandatory rules.
